Authorization of Independent Surveillance Companies

- The scope of the inspections which will be made by the Owner for the purpose of constructing nuclear plants in compliance with nuclear safety principles and related legislation and standards, the methods and principles regarding the authorization of independent surveillance companies to conduct such inspections, the duties and responsibilities of interested parties, and the scope of the contract of service that will be concluded between independent surveillance company and the Owner is carried out in accordance with the requirements of Regulation on Independent Surveillance Activities At Nuclear Facilities, published in the Official Gazette dated 1/8/2024 and numbered 32619.
- Authorization conditions will be determined as a complementary annex of the Authorization Certificate for independent surveillance companies.
- Authorized companies and their authorization scope are announced on the Authority’s webpage.
- Independent surveillance companies can carry out surveillance on fields that comply with the extent of their authorization and the authorization conditions, in accordance with the terms of Contract of Service that they sign with the Owner (Legal person who has been given permission / license by the Authority to establish a nuclear facility).
- Independent surveillance companies that operate in accordance with the “Law on Construction Inspection” numbered 4708, are forbidden from engaging in any other business operation in accordance with the Article 3 of the Law titled “Responsibilities and Forbidden Commercial Operations”, where in the last paragraph it is stated that “A Construction Inspection Organization cannot engage in a commercial activity other than inspection activities. The inspector architects and engineers of the Organization are forbidden from carrying out any other occupational and construction-related activities within the duration of inspection activities.” Therefore, organizations that will receive a certificate of authorization from the Nuclear Regulatory Authority may lose the authority they have / will receive from the Ministry of Environment and Urbanization. Detailed information on the subject can be obtained from the relevant units of the Ministry of Environment and Urbanization.
Application Documents for Authorization and Guidance for Application
The qualifications required to be provided by the organizations that will apply for authorization as a independent surveillance company and the documents to be submitted to the Authority are determined by the Regulation on Independent Surveillance Activities At Nuclear Facilities published in the Official Gazette dated 1/8/2024 and numbered 32619.
For applications to be made to the NDK to obtain a Certificate of Authorization, it is essential to submit two copies of the documents, one hard copy and one electronic copy. It is the applicant's responsibility that the hard copy is produced from the electronic copy submitted to the Authority and that it is identical. Applicants cannot make any claim from the Authority due to the results arising from the difference of the copies.
Electronic versions of documents such as management system documents, technical capacity, human resources regulations and / or procedures among the application documents must be submitted in searchable format. Hardcopy documents must be submitted in original or, if the original cannot be submitted, a copy certified by the official authorities. The application documents are shown below.
2. Companies willing to provide surveillance services for nuclear facilities shall attach to the petition
a) Official documents showing that the company carries out active and registered commercial activities,
b) The documents showing the persons authorized to represent and their signature declaration or circular approved by the competent authorities,
c) Information on the organizational structure, duties, authorities and responsibilities of its units, technical capacity and similar experiences for the authority requested,
d) A letter from the Turkish Accreditation Agency showing that the management system certificates and the management system certificate obtained according to the ISO 9001 standard have been issued by certification bodies accredited by the Turkish Accreditation Agency or certification bodies accredited by the accreditation bodies included in the International Accreditation Forum Mutual Recognition Treaty,
e) Arrangements and/or procedures for human resources management, conformity assessment, audits and nonconformity management,
by submitting an application to the Authority.
3. In addition to the first paragraph, companies willing to provide surveillance services in the safety-significant category shall attach to their application information and documents regarding their regulations, practices and/or procedures regarding safety-related issues such as establishing and maintaining a safety culture, providing trainings to be conducted within this scope and applying the graded approach.
Note 1: The Authority may request additional information and documents if it considers necessary.
Note 2: The above-mentioned application documents should provide information that will form the basis for the assessment of the competence of the organization for the authorization applied for. The following points are prepared for guidance purposes, these or similar information may be included in these documents:
- Information on the organization's experience, know-how, resources and lessons learned based on its experience in the field for which it is applying for authorization
- In the similar work experience section, supporting information such as the duties of the applicant organization in the relevant project, the scope of the project, other stakeholders of the project (client), benefits of being in the project to the applicant
- Information on the quality management system in place and other management systems, if any (Information on the ISO 9001 or equivalent quality management system required by the Regulation, as well as information on ISO 17020 or similar accreditations, if any)
- Information on the applicant's arrangements regarding independence, impartiality and confidentiality to prevent conflicts of interest within the framework of oversight activities
- Information on the clear definition of the organizational structure in which surveillance services will be provided (specifying in detail the location of the surveillance unit within the organizational structure in organizations that provide services outside of surveillance activities)
- Information on decision-making mechanisms and the authorities and responsibilities of those involved in the audit process, especially auditors
- Information on the organization's competencies and arrangements for meeting the requirements of this area-specific issues such as safety culture, graded approach in authorization applications for the inspection of safety-relevant structures, systems and components.
Note 3: The following items have been prepared for guidance, these or similar information may be presented in application documents to meet the requirement and for the required evaluation:
- Regulations of applicant regarding staff recruitment and staff qualification (Including in detail the regulations regarding the inspectors involved in the surveillance activities and their superiors)
o Recruitment
o Providing necessary competencies, basic training, retraining, on-the-job training, etc. (Examples from the applied training modules can be presented)o Competency assessments
- Surveillance technical competencies
o General surveillance procedures including the steps such as planning, performing, reporting and recording surveillanceso Surveillance procedures specific to the construction of safety-critical structures, the assembly of systems, the manufacturing of equipment and the commissioning of safety-critical structures, systems and equipment by sampling related to the activities that authorization application madeo Records and forms to be kept in the surveillance processo Form and record samples from previous inspection, audit and control activities carried out (by closing confidential parts, if any) can be used to demonstrate competence
4. The organization's written statement that it will employ trustworthy personnel consistent with the principle of independent decision making.
* All documents are presented in Turkish and/or English. Official documents should be submitted as apostilled and notarized. For translated documents, copy of approved translator certificate also should be submitted.
