Authorization of Nuclear Construction Inspection Organizations

In accordance with Article 4, subparagraph d of sub-clause 4 of Nuclear Regulation Law No 7381 dated 05/03/2022 ”Companies performing third party surveillance” are among the issues that are required to obtain an authorization certificate from the Nuclear Regulatory Authority. In this context, some information regarding the authorization of organizations to take part in the construction inspection activities of nuclear power plants are given below:

  1. The scope of the inspections which will be made by the Owner for the purpose of constructing nuclear plants in compliance with nuclear safety principles and related legislation and standards, the methods and principles regarding the authorization of nuclear construction inspection organizations to conduct such inspections, the duties and responsibilities of interested parties, and the scope of the contract of service that will be concluded between nuclear construction inspection organization and the Owner is carried out in accordance with the requirements of Regulation on Construction Inspection of the Nuclear Power Plants, Official Gazette Number: 30024 Date of Official Gazette: 31.03.2017
  2. Authorization conditions will be determined as a complementary annex of the Authorization Certificate for Nuclear Construction Inspection Organizations.
  3. Authorized Organizations and their authorization scope are announced on the Authority’s webpage.
  4. Nuclear Construction Inspection Organizations can carry out inspections on fields that comply with the extent of their authorization and the authorization conditions, in accordance with the terms of Contract of Service that they sign with the Owner (Legal person who has been given permission / license by the Authority to establish a nuclear facility).
  5. Construction inspection organizations that operate in accordance with the “Law on Construction Inspection” numbered 4708, are forbidden from engaging in any other business operation in accordance with the Article 3 of the Law titled “Responsibilities and Forbidden Commercial Operations”, where in the last paragraph it is stated that “A Construction Inspection Organization cannot engage in a commercial activity other than inspection activities. The inspector architects and engineers of the Organization are forbidden from carrying out any other occupational and construction-related activities within the duration of inspection activities.” Therefore, organizations that will receive a certificate of authorization from the Nuclear Regulatory Authority may lose the authority they have / will receive from the Ministry of Environment and Urbanization. Detailed information on the subject can be obtained from the relevant units of the Ministry of Environment and Urbanization.
  6. In accordance with the first paragraph of Article 9 (a) of the Presidential Decree No. 95 on the Organization and Duties of the Nuclear Regulatory Authority, and in accordance with the second paragraph of Article 18, the second paragraph of Article 46, and the fifth paragraph of the temporary Article 1 of the "Regulation on Authorizations Regarding Nuclear Facilities" published in the Official Gazette dated 17/3/2023 and numbered 32135, until the regulation regarding the authorization of Independent Inspection Companies comes into force, if nuclear construction inspection organizations with authorization certificates wish to participate in the inspection of activities during the commissioning process of nuclear facilities for important structures, systems, and components from the perspective of nuclear safety, their authorization certificates will be limited to the validity period. In such cases, if they demonstrate their qualifications by providing, information and documents showing their experience in the commissioning process of the Organization, procedures and forms to be used in commissioning inspections, the inclusion of commissioning inspections of nuclear facilities in the authorization conditions of these nuclear construction inspection organizations has been decided

The qualifications required to be provided by the organizations that will apply for authorization as a nuclear construction inspection organization and the documents to be submitted to the Authority are determined by the Regulation on Construction Inspection of Nuclear Power Plants.

For applications to NDK to obtain a Certificate of Authorization, the following documents are submitted in printed and electronic form. It is the applicant's responsibility to ensure that the electronic copies are the same as the hard copy. Documents such as management system documents, technical capacity, regulations on human resources included among the application documents should be submitted in a searchable format on electronic versions. The original printed documents, or if the original cannot be presented, a copy approved by the official authorities is submitted. Application documents are listed below:

1. Application Form

2. Official documents proves that the Organization is active and performs registered commercial activities,

3. Organization’s documents listing representing staff, this staff’s approved statement of signature or authorized signatory list,

4. A report containing the organizational structure, technical capability, human resources information and past experience in construction inspection of the Organization,

Note 1: The information that will serve as the basis for the evaluation of the organization's competence regarding the authorization applied should be presented with this report. The following items have been prepared for guidance, these and similar information may be included in the report:
  • Information about knowledge, resources and experiences in the field applied for authorization and also the lessons learned based on the experience
  • Presenting similar work experience with information such as tasks of the applicant in the relevant project, the scope of the project, other stakeholders (customers) of the project, and the benefits of being in the project to the applicant
  • Information about the quality management system in place and other management systems (Information on ISO 9001 or an equivalent quality management system is required by the Regulation, in addition to this the information on ISO 17020 or similar certifications are presented if any)
  • Information on the applicant's regulations on independence, impartiality and confidentiality in order to prevent conflict of interest within the framework of inspection activities
  • Information on the clear definition of the organizational structure in which inspection services will be provided (details of the state of the inspection unit in the organizational structure in organizations that also provide services other than inspection activities)
  • Information on decision-making mechanisms and the powers and responsibilities of those involved in the inspection process, especially of inspectors
  • Information about the organization's competencies and regulations in meeting the requirements of nuclear safety related area, such as nuclear safety culture, graded approach etc. (Regarding applications for authorization to inspect important structures, systems and components in terms of nuclear safety)

5. Documents presenting the Organization’s qualifications as indicated in Article 13 of Regulation, in accordance with demanded authorization extent;

a. An internationally valid quality management system certificate of the organization,

b. A letter taken from the Turkish Accreditation Agency, showing that the quality management system certification is issued by a certification body accredited by Turkish Accreditation Agency or an accreditation body included in the International Accreditation Forum Mutual Recognition Agreement,

c. Documents and procedures related to human resources management and inspection process within the Organization’s quality management system documents,

Note 2: The following items have been prepared for guidance, these or similar information may be presented in application documents to meet the requirement and for the required evaluation:

  • Regulations of applicant regarding staff recruitment and staff qualification (Including in detail the regulations regarding the inspectors involved in the inspection process and their superiors)

    • Recruitment
    • Providing necessary competencies, basic training, retraining, on-the-job training, etc. (Examples from the applied training modules can be presented)
    • Competency assessments

  • Arrangements for providing a flexible structure that responds quickly to workload changes
  • Inspection technical competencies

    • General inspection procedures including the steps such as planning, performing, reporting and recording inspections
    • Inspection procedures specific to the structure, system and components selected by sampling related to the activities that authorization application made
    • Records and forms to be kept in the inspection process
    • Form and record samples from previous inspection, audit and control activities carried out (by closing confidential parts, if any) can be used to demonstrate competence

6. Documents issued to Organization by other states regulatory bodies’ related to inspections of structures, systems and components, if any.

7. Written declaration (commitment) of the organization that it will only employ reliable personnel.

* All documents are presented in Turkish and/or English. Official documents should be submitted as apostilled and notarized. For translated documents, copy of approved translator certificate also should be submitted.

For applications to be made by domestic companies, the application form have to also be filled in via the E-Government (E-Devlet) system. And the relevant service / transaction fee specified in the List of Fees for Basic Goods and Services announced by the NDK for each financial year have to be deposited into the Authority's account together with the accrual number to be given after the application.
